Terms & Conditions
Last updated 11 July 2026. These Terms govern your use of the LDPS Africa Intelligence Platform™, operated by LDPS Africa.
1. Who you are contracting with
These Terms & Conditions form a binding agreement between you and LDPS Africa ("LDPS Africa", "we", "us", "our"), operator of the LDPS Africa Intelligence Platform™ (the "Service"). By creating an account, subscribing, or otherwise using the Service, you agree to these Terms.
2. Acceptance
By continued use of the Service you confirm that you accept these Terms, that you are of legal age or authorised to bind the organisation you represent, and that the information you provide is accurate and kept up to date.
3. The Service
LDPS Africa provides livestock performance analytics, nutrition economics, benchmarking, advisory and reporting tools delivered as a subscription-based web platform. Features available to you depend on your subscription plan.
4. Acceptable use
You must not misuse the Service. In particular you must not (a) use it for any unlawful, fraudulent or deceptive purpose; (b) send spam or infringe third-party intellectual property; (c) attempt to interfere with the Service's security, including by introducing malware, probing, scanning, or scraping; or (d) reverse engineer, resell, or redistribute the Service except as expressly permitted.
5. Account security
You are responsible for keeping your credentials confidential and for all activity under your account. Notify us immediately at admin@ldpsafrica.com if you suspect unauthorised access.
6. Intellectual property
LDPS Africa retains all right, title and interest in and to the Service, including the software, documentation, branding, methodologies, benchmark datasets, and any derivative works. You receive a limited, non-exclusive, non-transferable right to use the Service within the scope of your subscription plan.
7. Your data
You retain ownership of the operational data you upload. You grant LDPS Africa a limited licence to host, process, and analyse that data solely to provide the Service, generate your reports, and produce aggregated, non-identifying benchmarks. See our Privacy Notice for details.
8. Service level
We work to keep the Service available and accurate, but we do not warrant that it will be uninterrupted, error-free, or fit for any particular purpose. To the fullest extent permitted by law, all implied warranties are disclaimed.
9. Payments, billing and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, taxes, renewals, cancellations and refund mechanics are governed by the Paddle Checkout Buyer Terms at https://www.paddle.com/legal/checkout-buyer-terms and our Refund Policy.
10. Refunds
We offer a 30-day money-back guarantee on paid subscriptions. See our Refund Policy for how to request a refund through Paddle.
11. Suspension and termination
We may suspend or terminate your access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious violations of our acceptable use rules. You may cancel your subscription at any time through the billing portal; access continues until the end of the paid period unless a refund is issued.
12. Limitation of liability
To the fullest extent permitted by law, LDPS Africa's aggregate liability arising out of or related to the Service is limited to the fees you paid for the Service in the twelve (12) months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special or punitive damages, including loss of profits, data, goodwill, or livestock outcomes. Nothing in these Terms excludes liability that cannot be excluded under applicable law.
13. Indemnity
You agree to indemnify LDPS Africa against third-party claims arising from your content, your unlawful use of the Service, or your breach of these Terms.
14. Changes to the Service or Terms
We may update the Service and these Terms from time to time. Material changes will be communicated by email or in-product notice. Continued use of the Service after changes take effect constitutes acceptance.
15. Governing law
These Terms are governed by the laws of the Republic of Kenya. Disputes will be submitted to the exclusive jurisdiction of the courts of Nairobi, Kenya, save where mandatory consumer-protection law provides otherwise.
